When in doubt, this should be noted by a competent inspector in their report, to alert the buyers legal representative to have the property boundaries checked by a qualified surveyor. This serious problem may affect future resale of the property.

Buildings encroaching on the boundary.

Unfortunately the shadow in this photo hides the fact that these new neighboring buildings are overlapping. Overlapping of the building structures may have consequences when either property are placed on the market for sale in the future.

Never use fences as a true guage of boundary locations.

  • Fences are not necessarily a true indication of the boundary locations, therefore they must not be used to determine their position.
  • A qualified surveyor must be employed to give an accurate determination of the boundary locations.
  • This problem may affect resale of the property.

If in doubt, check with your legal representative for advice regarding the consequences.
